IP Firms: Building an Inbound Foreign Associate Network

How IP firms win inbound filings from overseas agents through reciprocity, responsiveness and conference follow-up.

The answer

A large share of an IP firm’s filings come from foreign associates who need a local firm to file and prosecute in your jurisdiction. That work goes to the firms that respond fastest, report clearly and send reciprocal work. A deliberate associate network programme turns conferences and referrals into predictable instructions.

How the associate market works

When a client in one country wants protection in another, its home attorney instructs a local firm. The home attorney chooses based on past experience, responsiveness, cost transparency and whether the local firm sends work back. Relationships are built over years, often through international IP conferences and association meetings.

The programme

  1. List your top 50 inbound and outbound associates by volume.
  2. Measure reciprocity: work sent versus received for each.
  3. Plan conference meetings with the top 20 before each event, not during it.
  4. Send a short annual service report to each associate.
  5. Follow up every new contact within a week with something useful, such as a practice update for your jurisdiction.

Guardrails

  • Reciprocal referral arrangements must not compromise client choice or independent judgement; under ABA Rule 7.2(b)(4) they must be non-exclusive and clients informed.
  • Never let reciprocity override the client’s interest in the best local counsel.

What to measure

  • Inbound instructions per associate.
  • Reciprocity ratio.
  • Response time to new instructions.
  • New associates instructing per year.
