One lawyer, three choices, zero time: how to pick your paralegal model

Most firms frame this as a hiring decision. It is really a workload decision. Choose in-house paralegals for work that needs judgement and constant contact, freelancers for short, specific projects, and a managed virtual team for high-volume, repeatable work. The mistake I see most often is a firm picking one model and forcing every task through it.

I spent years on the vendor side of this conversation with US firms. Here is how the three options actually compare.

In-house: control, at a fixed cost

An in-house paralegal gives you control, context and someone who can walk into your office. The cost is fixed whether your docket is full or not. BLS puts the median paralegal wage at $62,890, before benefits, space, software and training. Billing is the other side of that ledger: NALA's 2024 survey reports paralegal billing rates averaging $134 an hour, and compensation up 15% between 2022 and 2024, the biggest jump NALA has recorded since 2002.

Hiring is not getting easier through growth either. BLS now projects no net growth in paralegal jobs from 2025 to 2035, partly because AI makes each paralegal more productive. Openings will come from people leaving, which means you compete for experienced hires rather than drawing from an expanding pool.

Freelance: speed, with variance

A freelance paralegal can start next week on a discrete project, like a trial binder or a one-off discovery push. The trade-off is consistency. Quality, availability and data security vary by person, and your ethical duties do not change because the worker is independent. The ABA's outsourcing guidance is clear that the lawyer remains responsible for competent work and for protecting client confidences.

Freelancers work best when the task has a clear start, a clear end and a firm owner who reviews the output.

Managed virtual teams: scale, if you invest in setup

A managed team brings process, backup cover and volume capacity. Remote work is no longer the obstacle: in the ABA's 2022 practice survey, 87% of lawyers said their workplace allowed remote work, and NALA reports 71% of paralegals now have flexible arrangements. The real cost is onboarding. Templates, naming conventions and review checklists have to be agreed at the start, or the first month produces rework.

This model suits practices with steady, repeatable output: medical record summaries, demand packages, deposition summaries and discovery responses in PI, mass tort and insurance defence.

Match the model to the work

  • High-touch, sensitive matters and IP portfolios: keep them in-house.
  • Short spikes and niche projects: freelancers with a named reviewer.
  • Volume work with a template: a managed virtual team.
  • Most growing firms: a hybrid, with in-house staff owning client contact and quality control while external teams carry the volume.

AI is now a fourth option inside all three. Thomson Reuters estimates legal professionals will free up nearly 240 hours a year with AI. That time only turns into capacity if someone redesigns the workflow around it.

What to do this week

  1. List every recurring support task from the last 90 days and mark each one as judgement, spike or volume.
  2. Calculate the fully loaded cost of one in-house paralegal, including benefits, space and software, and compare it with the volume they actually handle.
  3. Pick one volume task and pilot it with an external team for 30 days, with a written checklist and a named reviewer.
  4. Check your engagement letters and confidentiality terms against ABA Formal Opinion 08-451 before any client file leaves the building.
